Marcelito Maagma's challenge came more than two weeks after the BFAR announced on Nov. 13 that Batan Bay, a rich fishing ground in Aklan, and its tributaries were positive for red tide. In a bulletin issued on Dec. 5, the agency said Batan Bay remains to be one of the areas where paralytic shellfish poison is beyond the regulatory limit.en
